Terms of Service

1. Introduction & Acceptance

1.1 Who We Are

These Terms of Service ("Terms") are a legally binding agreement between you ("User," "you," or "your") and Zelfium Inc., a company incorporated in Tokyo, Japan ("Zelfium," "we," "us," or "our"). They govern your access to and use of the Zelfium platform, available at zelfium.com (the "Website"), and all related products, features, and services.

1.2 Definitions

• "Service" means the Zelfium platform as a whole, including the Website, Assessment, AI Features, and all associated applications and tools.
• "Assessment" means the 77-question Likert-scale personality questionnaire powered by the SymbolMAG methodology.
• "Profile" means the personality profile generated from your Assessment responses, comprising 8 main scales, 16 subscales, and 41 components.
• "AI Features" means AI-powered functionality, including chat-based career guidance, compatibility insights, and related generative outputs.
• "Content" means all text, data, graphics, analyses, recommendations, and other materials generated by or displayed through the Service.
• "User" means any individual who creates an account or otherwise accesses the Service.
• "Affinia" means Zelfium Affinia, a generative AI agent that provides relationship compatibility insights based on personality profiles.
• "Libra" means Zelfium Libra, a career pathing tool that maps personality profiles to occupational paths.

1.3 Acceptance of Terms

By creating an account, completing an Assessment, or otherwise using the Service, you confirm that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, our Acceptable Use Policy, and our Cookie Policy, Tokushoho Disclosure, B2B Terms (where applicable), and Data Processing Agreement (where applicable). If you do not agree, you must not use the Service.

1.4 Eligibility

You must be at least 16 years of age to use the Service. In jurisdictions where the Children's Online Privacy Protection Act (COPPA) applies, users under 13 are not permitted to use the Service. Users under 18 may use the free tier of the Service but are not permitted to purchase paid subscriptions or make payments without the consent of a parent or legal guardian. By using the Service, you represent that you meet these age requirements.

2. Account Registration & Security

2.1 Account Creation

To access most features of the Service, you must register for an account. You may register using an email address and password or through a supported OAuth provider (Google, Microsoft, or Apple).

2.2 One Account Per Person

Each individual may maintain only one account. Creating multiple accounts to circumvent restrictions, manipulate Assessment results, or abuse the Service is prohibited and may result in termination of all associated accounts.

2.3 Account Security

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to:

• Choose a strong, unique password (if using email/password authentication).
• Not share your account credentials with any other person.
• Notify us immediately at contact@zelfium.com if you suspect unauthorized access to your account.

Zelfium is not liable for any loss or damage arising from your failure to protect your account credentials.

2.4 Account Information Accuracy

You agree to provide accurate, current, and complete information during registration and to keep your account information up to date. We reserve the right to suspend or terminate accounts that contain materially inaccurate information.

3. Description of Services

3.1 Personality Assessment (SymbolMAG)

The core of the Zelfium platform is a 77-question Likert-scale personality assessment built on the proprietary SymbolMAG methodology. Upon completion, the system generates a detailed personality Profile comprising 8 main scales, 16 subscales, and 41 components. This Profile forms the foundation for all other Zelfium features.

3.2 Zelfium Affinia

Affinia is a generative AI agent that analyzes the personality Profiles of two or more individuals to provide relationship compatibility insights. Affinia uses AI-powered chat to help users explore interpersonal dynamics, communication styles, and areas of alignment or potential friction.

3.3 Zelfium Libra

Libra is a career pathing tool that maps your personality Profile to occupational paths. It provides AI-driven guidance on career directions that may align with your personality traits, strengths, and preferences.

3.4 AI Chat Features

Both Affinia and Libra include AI-powered conversational features that allow you to explore your results in depth, ask follow-up questions, and receive personalized guidance. These features are subject to the AI-Generated Content provisions in Section 5.

3.5 Service Modifications

We continuously improve the Service and may add, modify, or discontinue features at any time. Where a change materially reduces the functionality available under your current subscription, we will provide at least 30 days' notice. Free-tier features may be modified or removed without prior notice.

4. Assessment-Specific Terms

4.1 Not a Clinical or Diagnostic Tool

The Assessment is designed for personal insight and self-development purposes only. It is not a clinical, psychological, or diagnostic instrument. The Assessment does not diagnose mental health conditions, learning disabilities, or any medical condition. It should not be used as a substitute for professional psychological evaluation or treatment.

4.2 Accuracy Limitations

While the SymbolMAG methodology has been developed through rigorous research, no personality assessment can capture the full complexity of an individual. Your results reflect tendencies and patterns based on your self-reported responses at the time of assessment. Results may vary if you retake the Assessment at a different time or under different circumstances.

4.3 Prohibited Discriminatory Use

You may not use Assessment results, Profiles, or any Content derived from the Service to:

• Make or inform hiring, firing, promotion, or other employment decisions.
• Determine eligibility for insurance, lending, credit, housing, or other financial products.
• Discriminate against any individual on any basis, including but not limited to personality type, trait scores, or AI-generated characterizations.
• Screen, rank, or filter individuals for any purpose that has legal or similarly significant effects on them.

Violation of this provision is a material breach of these Terms and may result in immediate account termination and legal action.

4.4 Results Are Personal

Your Assessment results and Profile are personal to you. While you may choose to share your results with others, you do so at your own discretion and risk. You may not share another person's results without their explicit consent.

4.5 Right to Retake

You may retake the Assessment at any time, subject to any applicable cooldown periods or usage limits on your subscription tier. Retaking the Assessment generates a new Profile, which replaces your previous Profile as the active one. Previous Profiles may be retained in your account history.

5. AI-Generated Content

5.1 AI Technology Disclosure

The Service uses artificial intelligence technology, including OpenAI's GPT-4o model, to generate conversational responses, career recommendations, compatibility insights, and other Content. For more information about how AI is used in the Service, see our AI Disclaimer.

In compliance with EU AI Act Article 50, we disclose that: (a) content generated through Affinia and Libra is produced by AI systems; (b) assessment outputs involve automated profiling as defined under GDPR Article 22; and (c) no AI-generated output should be treated as a substitute for qualified professional judgment.

5.2 Informational Purposes Only

All AI-generated Content is provided for informational and educational purposes only. It does not constitute professional advice of any kind, including but not limited to:

• Psychological or mental health counseling.
• Career counseling or employment advice.
• Relationship or marriage counseling.
• Medical, legal, or financial advice.

5.3 No Guarantee of Accuracy

AI-generated Content may contain errors, inaccuracies, or information that is incomplete, outdated, or not applicable to your specific circumstances. AI models can produce outputs that appear confident but are incorrect ("hallucinations"). Zelfium does not warrant the accuracy, completeness, reliability, or suitability of any AI-generated Content.

5.4 User Responsibility

You are solely responsible for any decisions you make based on AI-generated Content. We strongly recommend that you consult qualified professionals before making significant life decisions related to career changes, relationships, education, or other areas informed by the Service.

5.5 AI Content Ownership

You retain the right to use AI-generated Content produced during your interactions with the Service for your personal, non-commercial purposes. Zelfium retains the right to use anonymized and aggregated interaction data to improve the Service, subject to our Privacy Policy.

6. User Conduct & Acceptable Use

6.1 Acceptable Use Policy

Your use of the Service is subject to our Acceptable Use Policy, which is incorporated into these Terms by reference. You agree to comply with it in full.

6.2 Prohibited Activities

Without limiting the Acceptable Use Policy, you agree not to:

• Use the Service for any illegal purpose or in violation of any applicable law or regulation.
• Attempt to gain unauthorized access to the Service, other users' accounts, or Zelfium's systems or networks.
• Interfere with or disrupt the integrity or performance of the Service.
• Use automated means (bots, scrapers, crawlers) to access the Service without our prior written consent.
• Impersonate any person or entity, or falsely represent your affiliation with any person or entity.
• Use the Service to harass, abuse, or harm another person.
• Attempt to manipulate Assessment results through dishonest responses or automated completion.
• Reverse-engineer, decompile, or disassemble any part of the Service, including the SymbolMAG scoring algorithms.

6.3 Enforcement

We reserve the right to investigate and take appropriate action against conduct that violates these Terms, including suspending or terminating your account, removing Content, and reporting violations to law enforcement authorities.

7. Payments, Subscriptions & Refunds

7.1 Free Tier

Certain features of the Service are available at no charge. Free-tier features may be modified, limited, or discontinued at our discretion.

7.2 Paid Subscriptions

Premium features are available through paid subscription plans. Subscription details, including pricing, features, and billing frequency, are displayed on the Service before purchase. Paid subscriptions are available only to users who are at least 18 years of age (or who have verifiable parental/guardian consent).

7.3 Payment Processing

All payments are processed through Stripe, a third-party payment processor. By subscribing to a paid plan, you agree to Stripe's Terms of Service. Zelfium does not store your full payment card details.

7.4 Auto-Renewal

Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You will be charged the then-current subscription price at each renewal. You may cancel auto-renewal at any time through your account settings, and cancellation will take effect at the end of the current billing period.

7.5 Currency and Taxes

Prices are displayed in the currency indicated on the pricing page. You are responsible for any applicable taxes, duties, or government-imposed charges associated with your use of the Service, unless otherwise stated.

7.6 Refunds and Cancellations

7.7 Price Changes

We may change subscription prices at any time. Price changes for existing subscribers will take effect at the start of the next billing period following at least 30 days' notice. If you do not agree to a price change, you may cancel your subscription before the new price takes effect.

8. Intellectual Property

8.1 Zelfium's Intellectual Property

The Service, including the SymbolMAG methodology, scoring algorithms, personality type classifications, scale and subscale definitions, assessment questions, website design, logos, trademarks, software, and all associated Content, is the exclusive property of Zelfium Inc. or its licensors and is protected by copyright, trademark, patent, trade secret, and other intellectual property laws.

8.2 Your Profile

You own the specific data points of your personality Profile as they pertain to you personally. This ownership means you may view, download, share, or delete your Profile data at any time. However, this ownership does not extend to the underlying methodology, scoring system, algorithms, or presentation formats used to generate your Profile.

8.3 License to Use the Service

Subject to your compliance with these Terms, Zelfium grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial purposes.

8.4 License You Grant to Zelfium

By using the Service, you grant Zelfium a non-exclusive, worldwide, royalty-free license to use your Assessment responses and Profile data in anonymized and aggregated form for the purposes of improving the Service, conducting research, and developing new features. This license does not permit Zelfium to identify you personally in any published research or analysis without your separate consent.

8.5 No Reverse Engineering

You may not reverse-engineer, decompile, disassemble, or otherwise attempt to discover the source code, scoring algorithms, weighting systems, or proprietary logic of the SymbolMAG methodology or any other part of the Service. This prohibition survives termination of your account.

8.6 Feedback

If you provide us with feedback, suggestions, or ideas about the Service, you grant us an unrestricted, irrevocable, worldwide, royalty-free license to use that feedback for any purpose without compensation or attribution to you.

9. Data & Privacy

9.1 Privacy Policy

Your privacy is important to us. Our collection, use, and protection of your personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference. Please read it carefully.

9.2 Data Processing Overview

In using the Service, we process the following categories of data:

• Account data: Email address, name, authentication provider information.
• Assessment data: Your responses to the 77 Assessment questions and the resulting personality Profile.
• Usage data: Interaction logs, feature usage, and session information.
• AI interaction data: Conversations with AI features, prompts, and generated responses.
• Payment data: Billing information processed through Stripe (we do not store full card details).

9.3 Account Deletion

You may request deletion of your account and associated personal data at any time through your account settings or by contacting us at contact@zelfium.com. Upon receiving a deletion request, we will delete your personal data in accordance with our Privacy Policy and applicable law, subject to any legal retention obligations.

9.4 Cookie Policy

Our use of cookies and similar technologies is described in our Cookie Policy.

10. Limitation of Liability

10.1 Service Provided "As Is"

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. ZELFIUM DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10.2 Assessment and AI Disclaimers

Without limiting the foregoing, Zelfium specifically disclaims any warranty or representation that:

• Assessment results are a complete or definitive measure of your personality.
• AI-generated Content constitutes professional advice of any kind.
• Career recommendations will lead to specific employment outcomes.
• Compatibility insights will predict the success or failure of any relationship.

10.3 Limitation of Damages

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ZELFIUM, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, AFFILIATES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE) AND EVEN IF ZELFIUM HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

10.4 Maximum Liability Cap

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ZELFIUM'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) ONE UNITED STATES DOLLAR (US $1.00); OR (B) THE TOTAL AMOUNT YOU PAID TO ZELFIUM IN THE ONE (1) MONTH IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

10.5 Consumer Protection Carve-Outs

Nothing in these Terms limits or excludes liability for: (a) death or personal injury caused by negligence; (b) fraud or fraudulent misrepresentation; (c) any liability that cannot be limited or excluded under applicable law, including but not limited to mandatory provisions of the Japanese Consumer Contract Act (Article 8) regarding liability for willful misconduct or gross negligence. For users in Japan, any provision that would be deemed an unfair contract term under the Consumer Contract Act shall be unenforceable to that extent.

If you are a consumer in the European Union, United Kingdom, or Australia, your statutory consumer rights are not affected by these Terms.

11. Indemnification

To the maximum extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Zelfium Inc., its directors, officers, employees, agents, affiliates, and licensors from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of or access to the Service.
• Your violation of these Terms or any applicable law.
• Your use of Assessment results or AI-generated Content in a manner prohibited by these Terms, including any discriminatory use.
• Any content or information you provide through the Service.
• Your infringement of any third party's rights.

This indemnification obligation does not apply to consumers in jurisdictions where indemnification clauses of this nature are not enforceable.

12. Dispute Resolution

12.1 Governing Law

These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of Japan, without regard to conflict-of-law principles. The United Nations Convention on Contracts for the International Sale of Goods (UN CISG) is expressly excluded.

12.2 Exclusive Jurisdiction

Any disputes arising under or in connection with these Terms that cannot be resolved informally shall be submitted to the exclusive jurisdiction of the courts located in Tokyo, Japan. Both parties consent to the personal jurisdiction of such courts.

12.3 Informal Resolution First

Before initiating any formal dispute resolution proceeding, you agree to first contact us at contact@zelfium.com and attempt to resolve the dispute informally for at least 30 days. Most disputes can be resolved through good-faith communication.

12.4 Consumer Protection Carve-Outs

If you are a consumer located in the European Union or United Kingdom, nothing in this section deprives you of the protection of the mandatory consumer protection provisions of the law of the country in which you reside, or of your right to bring a claim before the courts of your place of residence.

If you are a consumer located in Australia, nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010) that cannot be excluded, restricted, or modified by agreement.

13. Termination

13.1 Termination by You

You may terminate your account at any time by using the account deletion feature in your account settings or by contacting us at contact@zelfium.com. If you have an active paid subscription, cancellation of the subscription and termination of the account are separate actions. Terminating your account will also cancel any active subscription; however, no pro-rata refund will be provided for the remaining billing period unless required by applicable law.

13.2 Termination by Zelfium

Zelfium may suspend or terminate your account, with or without notice, if we reasonably believe that you have violated these Terms or any applicable law, or if your continued use of the Service poses a risk to Zelfium, other users, or third parties. Where practicable, we will provide notice and an explanation of the reason for termination.

13.3 Data Handling Post-Termination

Upon termination of your account (whether by you or by Zelfium), you will have a 30-day window to download your personal data, including your Assessment results and Profile. To request a data export during this period, contact us at contact@zelfium.com.

After the 30-day window, we will delete your personal data in accordance with our Privacy Policy, except where retention is required by law or for legitimate business purposes (such as fraud prevention or legal compliance).

13.4 Surviving Provisions

The following sections survive termination of these Terms: Section 4.3 (Prohibited Discriminatory Use), Section 5 (AI-Generated Content), Section 8 (Intellectual Property), Section 10 (Limitation of Liability), Section 11 (Indemnification), Section 12 (Dispute Resolution), and this Section 13.4.

14. Miscellaneous

14.1 Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, severed from these Terms. The remaining provisions shall continue in full force and effect.

14.2 Waiver

The failure of Zelfium to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by Zelfium.

14.3 Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. Zelfium may assign its rights and obligations under these Terms without restriction, including in connection with a merger, acquisition, corporate reorganization, or sale of all or substantially all of its assets.

14.4 Force Majeure

Zelfium shall not be liable for any failure or delay in performing its obligations under these Terms due to circumstances beyond its reasonable control, including but not limited to natural disasters, acts of government, pandemics, war, terrorism, labor disputes, power failures, internet or telecommunications disruptions, or failures of third-party service providers (including AI model providers and payment processors).

14.5 Entire Agreement

These Terms, together with the Privacy Policy, Acceptable Use Policy, Cookie Policy, and AI Disclaimer, constitute the entire agreement between you and Zelfium regarding the Service, and supersede all prior agreements, understandings, and communications, whether written or oral.

14.6 Notices

Zelfium may send notices to you via email (to the address associated with your account), through in-app notifications, or by posting notices on the Service. You may send notices to Zelfium at contact@zelfium.com for legal matters, or info@zelfium.com for general inquiries.

15. Changes to Terms

15.1 Right to Modify

We reserve the right to modify these Terms at any time. When we make changes, we will update the "Last Updated" date at the top of this page.

15.2 Notification of Changes

For minor changes (such as clarifications, formatting updates, or corrections that do not materially affect your rights or obligations), we will post the updated Terms on the Service. Your continued use of the Service after such changes constitutes your acceptance of the revised Terms.

For material changes (such as changes to pricing, data practices, liability provisions, or dispute resolution procedures), we will provide at least 30 days' advance notice through one or more of the following: email notification, prominent in-app notice, or a banner on the Website. Material changes will require your affirmative consent (such as clicking "I Agree") before taking effect. If you do not consent to a material change, you may terminate your account before the change takes effect.

15.3 Archived Versions

Previous versions of these Terms will be archived and made available upon request by contacting contact@zelfium.com.

16. Product Supplement — Affinia

16.1 Nature of Affinia Insights

Relationship compatibility insights provided by Affinia are for reference and self-reflection only. Affinia does not provide relationship counseling, therapeutic advice, or any form of professional guidance regarding interpersonal relationships.

16.2 Consent for Sharing

Sharing another person's personality Profile through Affinia requires that person's explicit consent. You are solely responsible for obtaining such consent before initiating any two-person or multi-person compatibility assessment.

16.3 Two-Person Assessments

When Affinia performs a two-person compatibility assessment, both parties' data is processed to generate the compatibility insights. Each individual retains their individual rights over their own data as described in Section 9 (Data & Privacy) and our Privacy Policy.

16.4 Data Scope

Affinia does not store or analyze relationship history, communications, or behavior patterns. Compatibility insights are derived solely from personality Profile data generated through the SymbolMAG Assessment.

17. Product Supplement — Libra

17.1 Nature of Libra Guidance

Career pathing information provided by Libra is for guidance and exploration only. Libra does not constitute career counseling, employment advice, or any form of professional vocational guidance.

17.2 High-Risk AI Disclosure (EU AI Act)

When Libra results are used by organizations in employment-related contexts (such as recruitment, screening, or workforce planning), Libra may be classified as a high-risk AI system under EU AI Act Annex III, Category 4 (Employment, Workers Management, and Access to Self-Employment).

17.3 Prohibited Employment Use

Assessment results generated through Libra must not be used as the sole or primary basis for hiring, firing, promotion, or other employment decisions. Human oversight is mandatory for any employment-related use of Libra outputs.

17.4 Organizational Use

Organizations using Libra for employment-related purposes must comply with our B2B Terms, including the Deployment Purpose Declaration requirement.

18. Product Supplement — SMAG (SymbolMAG API)

18.1 Governing Terms

API access to SMAG is governed by our B2B Terms, which supplement these Terms. In the event of a conflict between these Terms and the B2B Terms regarding API usage, the B2B Terms shall prevail.

18.2 Rate Limits and Usage Quotas

Rate limits and usage quotas apply per subscription tier. Exceeding applicable limits may result in throttling, temporary suspension of API access, or additional charges as specified in your subscription agreement.

18.3 Data Retention

Assessment data processed through the SMAG API is retained for the duration of the contractual period. Upon termination or expiration of the contract, data is deleted in accordance with the Data Processing Agreement.

18.4 API Versioning

Zelfium provides at least 90 days' deprecation notice for breaking changes to the SMAG API. Non-breaking changes (such as additive fields or new endpoints) may be introduced without prior notice.

18.5 Proprietary Methodology

The SymbolMAG methodology is proprietary. Reverse engineering, decompilation, or creation of derivative assessment tools based on SMAG outputs or methodology is strictly prohibited. This prohibition applies to both direct and indirect derivation of scoring logic, scale definitions, or assessment frameworks.

18.6 Output Data License

Output data (including scores, profiles, and compatibility results) generated through the SMAG API is licensed for the Customer's authorized use only, as specified in the applicable B2B Terms and subscription agreement.
